Use of the School Survey site is subject to the terms of use set out below. It is important that you read and understand the terms of use before you start to use the site for survey administration. These terms of use may be amended from time to time. You are responsible for regularly reviewing them. Your continued use of this site constitutes your agreement to the current version of the terms of use.

Purpose

The purpose of this School Survey site is to enable schools and schooling systems to conduct surveys in their school communities and collect and report on survey data.

In these terms of use:

ACARA is the Australian Curriculum, Assessment and Reporting Authority;

ESA is Education Services Australia Limited, the organisation responsible for the development and maintenance of the School Survey site on behalf of ACARA and the Australian Government Department of Education until 30 June 2014;

Jurisdictional Library means the set of survey questions that a jurisdiction may choose to be used by survey administrative users in that jurisdiction;

National Library means the set of survey questions that are nationally agreed;

Personal Information means information or an opinion about an identified individual, or an individual who is reasonably identifiable whether the information or opinion is true or not and whether the information or opinion is recorded in a material form or not;

Survey Data means information provided in response to survey questions;

Survey Respondents means members of a school community who respond to surveys administered through the site; and

You means any system administrative user of this site other than survey respondents, and includes jurisdictional administrators, jurisdictional survey administrators, school administrators, survey administrators and survey editors.

Identification

As far as possible, You should not provide surveys that allow for identification of collected information with an individual. Although all survey distribution options are anonymous, be aware that small sample sizes and the use of demographic questions may make it possible to identify individuals who have provided the responses, in which case all responses are considered personal information.

Any personal information collected should be managed in accordance with Your school's or schooling system’s privacy policy. You should read this privacy policy before administering surveys to members of Your school community.

Collection, use, disclosure and ownership of Survey Data

Schools and schooling systems can use this site to set survey questions of their choosing. The site also contains questions in the National Library which Your school or schooling system may be required or invited to administer to parents, students and/or staff. Schooling systems may also add questions to the Jurisdictional Library, which schools may be required or invited to administer to parents, students and/or staff.

The school or schooling system that collects survey responses retains ownership of the Survey Data. Data collected can be reviewed and used by the school or schooling system that collected the data.

Data collected by schools using items from the National and Jurisdictional Libraries can also be viewed and reported on by the relevant schooling system in the case of government schools. In the case of non-government schools data collected by schools using items from the National and Jurisdictional Libraries can only be viewed and reported on by the collecting school, unless otherwise requested.

You must not, and Your school or schooling system must not to the best of its ability, publish Survey Data that could identify any individual.

You must provide terms of use for Your surveys and make these terms of use available to Survey Respondents. The terms of use should be consistent with Your school’s or schooling system’s policies and legal requirements, including privacy. While privacy requirements vary by jurisdiction, in general You should:

  • minimise collection of any information that might identify an individual; and
  • notify survey respondents of the intended uses of collected data that may be personal information and of any intended disclosures of this data.

ESA has provided default terms of use to be provided to Survey Respondents. You may use these default terms of use; however, ESA makes no representation or warranty about the accuracy, reliability, currency or completeness of these terms.

User conduct

You must not include any information in survey questions or terms of use for survey respondents that is unlawful, threatening, abusive, harassing, defamatory or offensive. ESA may delete information of this nature without notice.

You must not impersonate any other person or entity and should only login with Your own login details.

ESA may modify, suspend or discontinue any online survey without notice, on a temporary or permanent basis, if it is necessary for the integrity and availability of the site.

Storage of Survey Data

Survey data will be stored in Australia under the control of ESA. ESA has in place security measures to ensure that Survey Data is stored securely. Data stored by ESA will not be accessed by unauthorised third parties except where required by law.

Amendment of contact details

You will be able to log into the site and update or amend Your contact details.

General

Unless otherwise indicated, intellectual property rights subsisting in the site are owned by ESA on behalf of ACARA and the Australian Government Department of Education. You are not permitted to:

  • adapt the site for any purposes, whether non-commercial educational or otherwise
  • use the site or any part of it for commercial purposes or without the copyright notices and acknowledgements
  • do anything with the site that would infringe the moral rights of the creator of the site
  • circumvent any technological protection measure (for example, a password) or interfere with any electronic rights management information.
